Sec. 26-160. - Private swimming pools.

(a) A private swimming pool, as regulated herein, shall be any pool, pond, lake or open tank, not located within a completely enclosed building, and containing or normally capable of containing water to a depth at any point greater than one and one-half (1½) feet. No such swimming pool shall be allowed in any R district except as an accessory use to a residence or as a private club facility and unless it complies with this section.

(b) The pool shall be intended and shall be used solely for the enjoyment of the occupants of the principal building of the property on which it is located and their guests.

(c) The pool may be located anywhere on the premises except in required front yards, provided it shall not be located closer than ten (10) feet to any property line of the property on which located; provided, further, that pump and filter installations shall be located not closer than twenty (20) feet to any property line.

(d) The swimming pool, or the entire property on which it is located, shall be so walled or fenced as to prevent uncontrolled access by children from the street or from adjacent properties.

(e) Adequate provision for drainage shall be made subject to approval by the superintendent of utilities.

(f) Any lighting used to illuminate the pool area shall be so arranged as to deflect the light away from adjoining properties.

(g) No person shall construct or install a swimming pool or make any alteration therein or in the appurtenances thereof without having first submitted an application and plans therefor to the zoning inspector.
