Sec. 13-27. - Required. It shall be unlawful for any person to carry on or engage in any business, trade, calling, avocation or occupation named in this article and subject to a license tax without first having procured a license as required by this article. Sec. 13-28. - Application, issuance. Each application for a license required by this article shall be made to the city clerk in writing and shall be accompanied by the prescribed license fee or by a receipt from the city collector showing that the fee or tax prescribed by this article for such license has been paid, whereupon the city clerk shall prepare such license. Sec. 13-29. - Transfer, refunds. No license issued pursuant to this article shall be assignable or transferable, nor a protection to any other person than the licensee named therein. No money paid for any license required by this article shall be refunded by the city or any officer thereof. Sec. 13-30. - License year. Annual licenses under this article, unless provided otherwise, shall be issued for a calendar year beginning on January 1 and expiring December 31. |

Sec. 4-2. - License required. It shall be unlawful for any person, firm, partnership or corporation to manufacture, sell or expose for sale in this city intoxicating liquor or nonintoxicating beer in any quantity without taking out a license to be granted by action of the city clerk. It shall not be a defense to a prosecution under this chapter that the defendant is a private club, fraternal organization, or an employee of a private club or fraternal organizations where such intoxicating liquor or nonintoxicating beer is offered for sale only to members of such private club or fraternal organization. Sec. 4-3. - Qualification for license and renewal of license; penalty. See qualifications for license. Sec. 4-4. - Classification of licenses and annual fees. See license fees. Sec. 4-5. - Separate licenses required. A separate license shall be required for each place of business and each category of license pursuant to section 4-4. Every license issued shall expire on the 31st day of December next succeeding the date of such license. Of the annual license tax required in this chapter to be paid for any license, the applicant shall pay as many twelfths as there are months (part of a month counted as one (1) month) remaining from the date of the license, to, but not including, the next succeeding first day of January. No person shall sell, give away, consume, otherwise dispose of, or store upon any premises licensed under this chapter, any intoxicating liquor or nonintoxicating beer other than that permitted by the license issued. Sec. 4-6. - Original package not to be broken. It shall be unlawful for any person holding a permit authorizing the sale of intoxicating liquor or nonintoxicating beer in the original package to allow such original package to be broken or allow any of such beverage to be consumed in or upon the premises described in such permit, except during a licensed tasting event. Sec. 4-7. - Hours of sales. (a) No person having a license under this law, nor any employee of such person, except as provided in subsections 4-4(7), (8), (10), (14), (15) and (16) above shall sell, give away, or otherwise dispose of, or suffer the same to be done upon or about his premises, any intoxicating liquor in any quantity between the hours of 1:30 a.m. and 6:00 a.m. on weekdays and between the hours of 1:30 a.m. and 6:00 a.m. on Monday. If the person has a license to sell intoxicating liquor by the drink, his premises shall be and remain a closed place as defined in this section between the hours of 1:30 a.m. and 6:00 a.m. on weekdays and between the hours of 1:30 a.m. Sunday and 6:00 a.m. Monday. A "closed place" is defined as a place where all doors are locked and where no patrons are in the place or about the premises. (b) No person having a license under the provisions of this chapter, shall sell, give away or otherwise dispose of, or suffer the same to be done, upon or about this premises, any nonintoxicating beer in any quantity between the hours of 1:30 a.m. and 6:00 a.m. Sec. 4-8. - Resorts.
