Rental Inspections
The Landlord is required to get a Rental Inspection before the tenant can apply for electrical and water services in a rental space. The landlord can schedule an appointment by calling 660-679-6323, extension 2, or 660-679-4182.
Article IX. Residential Occupancy Permits of the City of Butler Municipal Code
(a) No person shall allow to be occupied, or shall rent to another for occupancy, any dwelling unit within a rental property without first receiving a residential occupancy permit from the City under the terms of this section.
(b) No City owned or controlled utilities will be turned on for any residential dwelling unit, unless and until a valid residential occupancy permit for such residential dwelling unit has been issued and is currently in effect.
(1) All residential dwelling units shall be inspected for conformance to the International Property Maintenance Code for minimum housing, building and sanitation standards, and including but not limited to roof repair and water damage, pest inspection, and all applicable dangerous buildings, nuisance, weed and junk ordinance provisions, before a residential occupancy permit shall be issued.
(c) No residential occupancy permit will be issued if the residential dwelling unit does not have an offstreet parking space within 1,000 feet of the main building structure of such residential dwelling unit.
(d) In cases of emergency or other unique circumstances, the Fire Chief or his authorized representative may authorize occupancy prior to inspection and the securing of a residential occupancy permit, provided the inspection and permit are issued as soon as practical. If the unit does not pass inspection, the Fire Chief or his authorized representative may allow necessary repairs to be made or he/she may direct the occupant to vacate the unit, depending on the severity of the deficiencies.
(e) A residential occupancy permit for newly constructed dwelling units within newly constructed rental property shall not be the same as the final building permit inspection and shall be valid until such time as the initial tenant vacates the unit, provided that the final building permit inspection required as a part of satisfying the provisions of the building code have been met prior to occupancy.
(f) A landlord, agent, builder, developer, or other party involved in the provision of housing shall secure a residential occupancy permit by any prospective occupants. An "open" permit valid for 90 days may be secured for vacant units prior to the designation of the prospective occupant. However, after 90 days or each time occupancy changes in a dwelling unit, a new residential occupancy permit shall be required.
